Jadoo TV Lawsuit – DISH Wins Lawsuit Against IPTV Box Company

The IPTV box distributor Jadoo TV has lost a piracy lawsuit against DISH Network.

The International Broadcaster Coalition Against Piracy (IBCAP) and its member, DISH Network, have won a protracted lawsuit against Jadoo TV and its CEO Sajid Sohail.

Jadoo TV is a well-known provider of set-top IPTV boxes. However, it wasn’t always known that pirated content was being distributed with the devices.

The California court granted a summary judgment, holding Jadoo TV and Sajid Sohail accountable for direct, contributory, and vicarious infringement.

This decision is notable as Sohail was found personally liable, which has implications for the ongoing bankruptcy proceedings of Jadoo TV.

In 2018, DISH Network accused Jadoo TV of copyright infringement, stating that the company had been conducting a large-scale, deliberate operation over several years to distribute channels exclusively licensed to the plaintiffs without authorization, violating 17 U.S.C. Section 501.

Sohail was also implicated because of his supposed authorization, direction, and involvement in Jadoo TV’s copyright infringements.

In response, Jadoo TV and Sohail rejected these allegations in 2019. However, when DISH Network submitted an amended complaint in 2020, the court ruled that the charges presented a plausible inference of Sohail’s involvement in the alleged infringements and rejected Sohail’s motion to dismiss.

Fast forward to March 2023, both DISH and Sohail filed motions for summary judgment. Judge Charles R. Breyer of the District Court favored DISH, denying Sohail’s motion.

The court found no genuine dispute about DISH’s ownership of the copyrighted material, the violation of DISH’s exclusive rights by the defendants, or Sohail’s personal liability as Jadoo’s director.

Regarding contributory infringement, the court ruled that Jadoo TV was aware of the infringement and could have easily taken measures to prevent it, making the company responsible.

The court also agreed with DISH’s claim of vicarious infringement, concluding that Jadoo TV had financially benefited from the infringement and had failed to control it.

Following these rulings, the court instructed both parties to propose what relief should be offered to DISH within 45 days.

DISH has proposed statutory damages, Jadoo’s profits, legal costs, and a permanent injunction.

The potential statutory damages could amount to $14.5 million if the court agrees to the maximum of $150,000 per work for the 97 works involved.

Additional damages or profits for works published outside the U.S. may also be considered. The final sum remains uncertain, but it is clear that Sohail cannot evade accountability.

This lawsuit, led by IBCAP, led to Jadoo TV declaring bankruptcy. However, the fact that Sohail was found personally liable means that recovery options are still possible.

“This ruling goes further than many other copyright cases coordinated by IBCAP. Here, the owner and CEO of one of the most popular South Asian services offering infringing content will not be permitted to hide behind a corporate shield and has been found personally liable for the damages caused by his and his company’s copyright infringement.”

“IBCAP and its members will not tolerate piracy, and the U.S. courts have once again not only sided with us by handing down a judgment against an infringing service, but also holding an owner personally accountable.”
